These Terms and Conditions apply when you visit capiaghisummer.com or purchase products from Capiaghi Summer.
This website is operated by J.A Capiaghi and C.I Summers trading as Capiaghi Summer (ABN 47 941 242 641).
By using our website or placing an order, you agree to these Terms and Conditions, together with our Privacy Policy, Shipping Policy and Returns Policy.
1. Orders
When placing an order, you agree that:

You are authorised to use the selected payment method.

You have reviewed the product description, price and delivery information before purchasing.
Receiving an order confirmation does not necessarily mean that we have accepted your order. An order is accepted when it has been processed for dispatch.
We may reasonably refuse or cancel an order if:

There is an obvious pricing or website error.

Payment cannot be authorised.

We reasonably suspect fraud, unauthorised activity or commercial resale.

We cannot deliver to the address provided.
If we cancel an order after payment has been received, we will notify you and issue a refund to the original payment method.
2. Prices and payment
All prices are displayed in Australian dollars unless otherwise stated.
Australian prices include GST where applicable. International duties, taxes and import charges may apply depending on the destination and will be handled as described in our Shipping Policy.
You must pay the total amount shown at checkout before your order is processed. Payments are handled securely by our third-party payment providers.
We take reasonable care to ensure our prices and product information are accurate. If an obvious error is identified after you place an order, we will contact you and provide the option to proceed at the correct price or cancel the order for a refund.
3. Product information and natural variations
We aim to display product descriptions, measurements, colours and images as accurately as possible. However, colours may appear differently depending on your screen and device settings.
Many Capiaghi Summer products are made using natural materials, including leather and cowhide. Natural variations in colour, grain, markings, hair direction and texture make each product unique. These disclosed natural characteristics are not ordinarily considered faults.
Handmade products may also have minor variations between individual pieces.
Nothing in this section excludes your rights where a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.
4. Availability and pre-orders
Products are subject to availability. Adding a product to your cart does not reserve it.
If we are unable to supply a product you have purchased, we will contact you and offer an appropriate solution, which may include a refund.
Where a product is sold as a pre-order, the estimated dispatch date will be stated on the relevant product page. Pre-order dates are estimates and may change due to production or shipping delays.
If a significant pre-order delay occurs, we will provide an update and any options available to you under Australian Consumer Law.
Orders containing both available and pre-order products may be dispatched together once all products are ready unless otherwise stated.
5. Shipping and delivery
Our Shipping Policy explains our shipping costs, estimated delivery timeframes, international duties and other delivery information.
Delivery dates are estimates unless we expressly agree to a guaranteed timeframe. Delays may occasionally occur due to customs, couriers, weather, peak periods or other circumstances outside our reasonable control.
We will provide reasonable assistance if an order is delayed, lost or damaged in transit. Nothing in these Terms limits any rights you may have if your order is not supplied within an agreed or reasonable time.
Customers are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if you notice an error. We cannot guarantee that delivery details can be changed after an order has been processed.
6. Returns and change of mind
Change-of-mind returns and exchanges are available only in accordance with our Returns Policy.

If a product has a minor problem, we may choose to provide a repair, replacement or refund within a reasonable time.
We may ask for proof of purchase and may need to inspect or assess the product before providing a remedy.
Your rights under Australian Consumer Law apply regardless of any change-of-mind conditions or timeframes in our Returns Policy. If these Terms or our Returns Policy are inconsistent with the Australian Consumer Law, the Australian Consumer Law will prevail.

The updated Terms will apply from the date they are published on our website. Changes will not retrospectively alter an order that we have already accepted unless required by law or agreed with you.
15. Governing law
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from them. This does not prevent you from exercising any rights available under applicable consumer law.
