TERMS AND CONDITIONS

1. GENERAL

  1. We offer refunds, repairs and replacements in accordance with the ACL and on the terms set out in our Returns Policy. 

  2. Any benefits set out in our Returns Policy may apply in addition to consumer's rights under the ACL.

  3. Before making a purchase, please read our Returns Policy so that you can understand your rights and what you can expect from us if you are not satisfied with your order. 

  4. All of our prices are in Australian dollars (AUD), unless expressly stated otherwise. 

  5. We reserve the right to cancel any order that appears suspicious or suggests fraudulent activity, including orders that do not appear to be intended for personal use.

  6. We may update our Terms and Conditions from time to time. Any changes will be effective upon posting the updated Terms and Conditions on our website capiaghisummer.com. We encourage you to review the Terms and Conditions periodically.


2. AUSTRALIAN CONSUMER LAW 

  1. Under the Australian Consumer Law (‘’ACL’’): 

    1. Our goods come with guarantees that cannot be excluded under the ACL. For major failures with the goods, you are entitled

      1. to cancel the purchase; and

      2. to a refund for the price of the goods.

    2. We offer refunds, repairs, and replacements in accordance with the ACL.

    3. The ACL provides a set of Consumer Guarantees which protect consumers when they buy products.

    4. If the ACL applies, then we cannot (and will not) avoid the Consumer Guarantees which it provides. 

    5. If there is an inconsistency between our Returns Policy and the ACL, the ACL will prevail.


3. CHANGE OF MIND

In the event that you receive the products you have purchased, but that you simply change your mind, we may, at our discretion, offer you a store credit or exchange, provided that you comply with all terms of our Returns Policy.
